Buck Design LLC and its affiliates (collectively “BUCK,” the “Company,” “we,” “our” or “us”) are committed to maintaining the confidentiality of the Personal Information of people who visit this website (the “Site”) and play our games. This Privacy Policy describes how BUCK collects, uses, and shares that Personal Information. It also describes the rights and remedies of California residents under the California Consumer Privacy Act of 2018.

What this policy covers. This Site, and the games BUCK publishes itself — currently Ladder Lad and Let’s! Revolution!.

What it does not cover. The Electric State: Kid Cosmo is published by Netflix and governed by Netflix’s own privacy policy, which is linked from the game’s store listing. Please read that policy for anything to do with Kid Cosmo. This policy also does not cover the stores you buy our games from — Steam, Nintendo, PlayStation, Xbox, the App Store, Google Play — each of which handles your purchase under its own policy.

As the Site and our games evolve and we perceive the need or desirability of using the Personal Information we collect from you in ways that are not described here, we may from time to time amend this Privacy Policy. The effective date appears at the top. We encourage you to check it from time to time to review the current policy in effect.

1. What this Site collects

The Site is deliberately built to collect as little as possible. What our games collect is described in section 2.

It sets no cookies. It stores nothing in your browser. It loads no third-party scripts, fonts, or tracking pixels, and makes no request to any third party until you ask it to — pressing play on a trailer loads it from YouTube. Until you do, YouTube does not know you were here. Soundtrack previews are our own files, served from this site, and reach nobody else.

The only form on the Site is the mailing list signup. If you use it, we collect your email address and the fact that you consented, and nothing else.

Our host keeps standard server logs, which include IP addresses, as part of running the Site.

For the purposes of this policy, “Personal Information” means information relating to a living individual who can be identified from that data, or from that data together with other information in our possession.

2. What our games collect

This section is about Ladder Lad and Let’s! Revolution!. It does not apply to Kid Cosmo — see the top of this policy.

Our games have no accounts and no sign-in. We do not ask you for your name, your email address, or anything else about you in order to play.

Crash and error reports. When a game crashes or hits an error, it sends a report to Backtrace, a crash-reporting service, so we can find the fault and fix it. A report describes what the game was doing when it failed and the specification of the system it was running on.

Gameplay analytics. We collect information about how our games are played — which levels are reached, where players get stuck — together with your system specification. We use it to understand what is working and to improve the games.

What this does and does not include. It carries no name, no email address, and nothing else that identifies you personally. We never ask you for any of that in order to play, and we cannot look at this data and tell who you are. But it is pseudonymous rather than anonymous: it describes a system and how it was played, and data of that kind can in principle be linked back to a person. So we treat it as Personal Information and it is covered by the rest of this policy, including your rights below.

You can turn all of it off. Both games have a setting that stops data collection entirely — crash reports and gameplay analytics together, not one or the other. With it off, the game sends us nothing.

We do not sell any of this, and we do not use it to advertise to you.

3. How we use it

We use Personal Information:

  • to send you news and updates about our games, if you have asked us to;
  • to keep the Site safe, secure, and working;
  • to find and fix faults in our games;
  • to understand how our games are played, so we can improve them;
  • to provide you with things you request from us; and
  • to comply with applicable laws and regulations.

BUCK does not collect or use Sensitive Personal Information, as the CCPA defines it, through the Site or our games.

4. The mailing list

The mailing list is operated by Mailchimp, a service of Intuit Inc., who act as our processor. When you sign up, your email address and consent are sent to Mailchimp and stored there.

Signing up is double opt-in: we add you as pending, and Mailchimp emails you to confirm. Until you confirm, you are not subscribed. Every email we send includes an unsubscribe link, and you can unsubscribe at any time. If you would rather we deleted your details outright, write to us and we will.

Mailchimp is based in the United States, so signing up involves a transfer of your email address outside the EU and UK.

5. Who else sees your Personal Information

We do not sell your Personal Information to anyone, and we do not share it to help anyone advertise to you.

We share it with service providers who help us run the Site and our games — currently our host, Mailchimp for the mailing list, and Backtrace for crash reports — under written agreements that restrict them from selling it, sharing it, or using it for anything other than the service they provide to us.

There are other circumstances in which we may share Personal Information:

Merger or sale. We may share information in connection with a prospective purchase, sale, or merger of all or part of our business, subject to appropriate confidentiality precautions.

Legal proceedings. We may share Personal Information in connection with actual or threatened legal proceedings, disclosing only what is necessary.

Legal obligations. We may share Personal Information where we are under a duty to do so to comply with a legal obligation or a lawful request by a public authority.

6. How long we keep it

We keep Personal Information for as long as we need it for the purposes set out above, or for as long as the law requires. If you unsubscribe from the mailing list, we keep a record that you did so, so that we do not add you again by mistake.

We use reasonable and appropriate measures to protect Personal Information from loss, misuse, and unauthorised access, disclosure, alteration, and destruction.

The Site and our games link out to other places — stores, social accounts, our Discord, and the sites of BUCK and Residence. Those are not covered by this policy, and we are not responsible for their privacy practices. Please read their policies before giving them any information.

8. Children

This Site is not designed or intended for use by children under 18, and we do not knowingly collect Personal Information from children under 13.

9. Additional rights for California residents

The California Consumer Privacy Act, as amended (the “CCPA”), gives California consumers the following rights over their Personal Information, subject to certain conditions and exemptions:

  • to request that we disclose what Personal Information we have collected, used, or disclosed over the preceding 12 months;
  • to request that we disclose whether any of your information was sold or shared with third parties, to whom, and why;
  • to request that inaccurate or incomplete Personal Information be corrected or supplemented; and
  • to request deletion of your Personal Information.

Non-discrimination. We will not deny you anything, or charge you differently, because you exercised any of these rights.

Making a request. Email us at info@buckgames.co. We are required to verify your identity before acting on a request, and will do so using information we already hold — typically by confirming from the email address we have on file.

Authorised agents. You may designate an authorised agent to exercise a CCPA right on your behalf. We will need written proof that you authorised them, and will separately verify your identity, or proof that the agent holds a power of attorney under California Probate Code §§ 4000–4465.

10. Changes to this policy

If you use this Site, any dispute over privacy is subject to this Privacy Policy, including limitations on damages, resolution of disputes, and application of the law of the State of California. As our business changes, this policy may change too. Unless stated otherwise, the current policy applies to all information we hold about you.
